OpenAI lawyers question Meta’s role in Elon Musk’s $97B takeover bid 

Meta has been subpoenaed by OpenAI for documents that could shed light on whether it engaged in discussions with Elon Musk and xAI about a potential takeover or investment in the ChatGPT developer.

The move was detailed Thursday in a filing connected to Musk’s ongoing lawsuit against OpenAI. Lawyers for the company said Meta was served with a subpoena in June seeking records related to Musk’s unsolicited $97 billion bid for OpenAI in February. Whether such records exist is not specified. The offer was ultimately rejected.

The filing is part of Musk’s lawsuit challenging OpenAI’s transition of its for-profit unit into a public benefit corporation, a change the company argues was needed to secure outside investment and lay the groundwork for a future public offering. Musk contends the change runs counter to OpenAI’s founding mission.

Meta’s legal team has asked the court to dismiss the subpoena, asserting that Musk and xAI can provide the relevant information. They also maintain that Meta’s internal conversations about OpenAI’s restructuring are irrelevant to the dispute.
